What is a Mechanic’s Lien?

A Mechanic’s Lien is a security interest in the title to real property. The purpose of a lien is to prevent landowners from benefiting from improvements to their property, such as labor and/or materials, without paying for the improvements. Mechanic’s Lien rights are governed by statute and require strict compliance with the statutory deadlines. Missing a deadline can result in the loss of your right to file or enforce a lien.

Who can file a Mechanic’s Lien?

Mechanic’s Liens may be filed by Contractors, Subcontractors and any other person who provides labor, services, equipment, and/or materials to a privately funded project to construct a work of improvement. Public buildings are not subject to Mechanic’s Liens.

How much can I claim in my Mechanic’s Lien?

The amount you can claim in your lien is limited to the value of the labor, services, or materials you provided. There is no minimum dollar value. Intentionally filing a lien for more than what you provided is an Abusive Lien and entitles the landowner to recover double damages from you. If you are successful in enforcing your lien you are entitled to recover your attorney’s fees and costs.

What is the first step for filing a Mechanic’s Lien?

File a Preliminary Notice. A Preliminary Notice must be filed with within 20 days of your first work on the project, or within 20 days after the notice of commencement is filed.

How do I file the Mechanic’s Lien?

A Mechanic’s Lien is filed with the County Recorder of the County where the property is located. You must file your Mechanic’s Lien within 90 days after the Notice of Completion is filed, or 180 days after final completion of work if no Notice of Completion is filed.
